Hi Guys,

In Ontario, all employees including contractors are qualify for pulic holidays from the first of day they start working for specific employer. We consultants or contractors don't need any more to wait 3 months to get holidays pay.

Good to know and good to remember.

Hi, as a contractor myself I must add that only full-time employees are paid on the statutory holidays. People who get paid by the hour and don’t work on a public holiday do not receive compensation.

Hi Contractor,
what you are saying is exactly what some staffing agencies whant us to believe and make us believing that we are not qualify. Poor them, they think that the only way to make money is to violate our rights.

Please read the following paragraph that was Extracted from Ontario Ministry of Labour Web page:

"Employees who qualify for public holiday entitlements can be full-time, part-time, permanent or on a limited-term contract. They can also be students. It does not matter how recently they were hired or how many days they worked before the public holiday."

Here is the link http://www.labour.gov.on.ca/english/news/2006/06-124b.html

Hope it helps.

Hey, thanks for the link.
When signing the contract you have to negotiate this because otherwise you will not be paid a penny.

Hi Contractor,

I believe, that we are not supposed to negotiate our rights; this is a right not a favour. Even if the agency make you signing a contract that says you are not eligible for Public Holidays, it doesn't mean that you sign away your rights, it is their responsibility to respect the Ontario Laws.

I'm not sure if all of consultants categories are qualify for holidays, it looks that it depends on your speciality. Please, see the following link
